General Terms and Conditions (T&C)
§ 1 Scope
These General Terms and Conditions apply to all purchases made through the online shop of Luminary Gallery. The contracting party is Luminary Gallery, 14 Cork Street, Mayfair, London W1S 3NS.
§ 2 Contract Formation
The display of products in the online shop does not constitute a legally binding offer, but an invitation to order. By submitting the order, the buyer makes a binding offer. The contract is concluded when we accept the order by an order confirmation email.
§ 3 Prices and Payment
All prices are final prices in euros. Payment is made via the secure payment service provider Stripe (credit card, SEPA direct debit). The charge is made upon order confirmation.
§ 4 Delivery and Shipping
Artworks are carefully packaged and shipped with insurance. Delivery times and shipping costs are displayed at checkout. Risk passes upon handover to the carrier.
§ 5 Retention of Title
The goods remain our property until full payment has been received.
§ 6 Warranty
Statutory warranty rights apply. For original works, we are obliged to guarantee authenticity and the described characteristics.
§ 7 Limitation of Liability
We are liable without limitation for intent and gross negligence and for damages arising from injury to life, body or health. Otherwise, liability is limited to foreseeable, contract-typical damage.
§ 8 Dispute Resolution
The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 9 Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies. Place of performance and jurisdiction is London W1S 3NS, provided the buyer is a merchant or has no general place of jurisdiction in Germany.
